You can see the balance of your funds in Amazon Seller Central. You earned those funds, Amazon collected them, and now you can’t withdraw them. Amazon can withhold funds pursuant to the Business Solutions Agreement, the terms of which all sellers accept upon account registration. The BSA gives Amazon sole and exclusive discretion over funds disbursements once an account is placed under review or deactivated.Your first step is to identify why Amazon is withholding your funds. Is it a policy violation, a contract breach, an IP complaint, or something else? Our withheld funds attorneys focus on reinstating your account and recovering withheld funds.
Reserve, Temporary Hold, or Withheld Funds: Which One Applies to You?
Sellers use these three terms interchangeably. Amazon doesn’t.
| What you’re looking at | Why it happens | Usual route out |
| Account Level Reserve | Standard contractual reserve authorized by the Business Solutions Agreement | Funds are released in accordance with your disbursement schedule |
| Disbursement on hold | A pending review, verification request, or investigation | Resolve the underlying review or verification |
| Funds withheld after deactivation | Account suspended or terminated under the Business Solutions Agreement | Reinstatement of the account, a written demand, or arbitration |
Check your Payments dashboard and your deactivation notice.. This will usually identify the nature of the funds withholding.
What the Business Solutions Agreement Says About Your Balance
The Business Solutions Agreement is the contract between Amazon and all third-party sellers. The BSA governs the disbursement of all sales proceeds. Section 3 of the BSA gives Amazon the contractual right to suspend or terminate your account. Section 2 of the BSA gives Amazon the contractual right to withhold payments if it suspects or identifies a contract breach, policy violations, fraud, deceptive, or illegal activity, or a need to withhold funds to cover refunds, chargebacks, and A-to-Z claims.
When sellers request a disbursement of withheld funds, they aren’t asking Amazon to return property it stole. They’re attempting to enforce a contract, which is why funds disbursement requests look like contract remedies rather than another round of appeals.
The 90-Day Question: What Actually Happens After Deactivation?
Amazon withholds an enforced account’s balance for roughly 90 days so it can settle buyer claims and other liabilities incurred as a result of the account’s operations.
The 90-day rule is practice rooted in contract. It’s not necessarily a deadline that sellers can count on. Plenty of sellers reach day 91 and find their balance remains on hold. This is true for virtually all deactivations. Waiting for Amazon to release your money is not a viable strategy because Amazon rarely releases funds to deactivated accounts. Especially after those accounts have appeared for and failed the virtual anti-fraud interview (the IPI).
What Happens to Your FBA Inventory While Funds Are Held?
stays in Amazon’s fulfillment centers and keeps accruing storage fees. Occasionally, sellers can submit a removal order while the account remains deactivated. Amazon will not release FBA inventory to accounts that are deactivated for product authenticity issues. For other deactivations, Amazon has discretion to release FBA inventory on a case-by-case basis.
Act on removals early. If your Amazon Seller Account is deactivated for an extended period, inventory is subject to disposal without reimbursement. Sellers should make sure stranded inventory is set for removal rather than disposal. Our inventory release page covers that side in detail.
Step One: Identify Amazon’s Claim(s)
Read the deactivation notice for the specific policy or contract provision cited by Amazon, then match it against your Payments dashboard.
Gather your documents while they are available: the deactivation notice; settlement and payment reports; buyer claim and chargeback data; supplier documentation; and every message you’ve exchanged with Seller Support. Sellers who lose account access lose access to their own evidence and data. A request for funds or inventory release requires access to critical data, so make sure you download all pertinent information if you need it for a subsequent demand.
Once you have your data, cross-reference the balance of withheld funds against fulfilled orders, claims, refunds, or chargebacks. The net figure becomes the balance of the funds you can legally attempt to recover.
Reinstatement and Fund Recovery Are Two Separate Tracks
Most sellers assume funds are released following an appeal. That’s not how it works.
If Amazon elects to reinstate your account then your funds will be released subject to ordinary reserves. A strong appeal or Plan of Action is often the fastest route to recovering your funds. But losing an appeal doesn’t automatically extinguish your right to withheld funds. Sellers pursue withheld balances months after Amazon enforced their account.
Start with an Internal Appeal or Escalation
Start your pursuit of withheld funds through internal appeal channels. Open a Seller Support case, use Account Health Support where the account still has access, and follow Amazon’s published escalation paths. Amazon will likely demand that you attend and pass their virtual anti-fraud interview. Per the BSA, passing the virtual interview is a condition precedent to funds disbursement.
Gather all your evidence and provide it to Amazon internally. Many cases can be resolved with provision of evidence requested by Amazon. If an internal appeal fails and Amazon continues to regurgitate the same response, stop submitting appeals. Submitting the same information repeatedly will not achieve your desired outcome.
Submit a Written Demand to Amazon
A demand letter from counsel does something a support ticket cannot. It states a contractual claim, identifies the sum in dispute and sets forth legal arguments.Written demands are issued to Amazon’s legal team through an external channel; they cannot be submitted through Seller Central.
A written demand’s tone is critical. A demand that overstates the claim, misreads the BSA, or threatens something you won’t pursue invites a short refusal and weakens your position. Treat the written demand as the first step of the informal dispute resolution process set forth in the BSA.
When Arbitration Becomes the Only Route
The Business Solutions Agreement mandates arbitration as the exclusive dispute resolution mechanism. The arbitration is administered by the American Arbitration Association (www.adr.org) .
Arbitration is viable only when Amazon is withholding a significant amount of money. Arbitration is expensive and time consuming. Not all cases are candidates for arbitration. Our guide to Amazon arbitration covers the process, the costs, and the cases it suits.
Mistakes That Make Recovery Harder
Sellers damage their own position in predictable ways. Opening a fresh account to keep selling converts a funds dispute into a fraud/deception case; Amazon treats these far more seriously than the original suspension. Filing a chargeback or bank dispute against Amazon can be a breach of the Business Solutions Agreement that you’re trying to enforce. Angry messages through Seller Support can result in Amazon restricting account access. And waiting patiently for an automatic release that will never come wastes precious time you should be spending to build your claim.
How Amazon Suspension Lawyer Approaches Withheld Funds
First, we identify the nature of the funds hold. Then we review your evidence and determine whether account reinstatement is viable. If internal appeals seem unlikely to release your funds, we pursue written demand, and when necessary, arbitration. Leo A. Vaisburg, Esq. personally leads that work and handles all arbitrations.
No firm can guarantee recovery. Every case is different and should be evaluated on its own merits.
Frequently Asked Questions
How long can Amazon hold my funds after a suspension?
Amazon generally holds funds for a minimum of 90 days to cover refunds, chargebacks, and A-to-Z claims. In practice most sellers exceed the 90-day mark without a release. This is especially true for cases involving product authenticity, fraud, deception, or illegal activities. The 90-day mark is theoretical; it’s not an enforceable deadline.
Can I get my money back if my account is never reinstated?
Sometimes. Reinstatement and fund recovery run on separate tracks, so losing an appeal for reinstatement does not by itself end your claim to your funds. Some sellers pursue the money through a demand or arbitration after the account has gone permanently. But some misconduct can result in a permanent confiscation of your funds. It is a case-by-case analysis.
Why is Amazon holding my funds when my account was deactivated over a listing issue?
The Business Solutions Agreement lets Amazon withhold funds where it identifies or suspects a contract or policy breach, fraudulent, deceptive, or illegal activity, or to cover potential claims.
What happens to my FBA inventory while my funds are held?
Inventory follows a separate process. FBA inventory generally stays in Amazon’s fulfillment centers accruing fees. While you can submit a removal order, Amazon is not obligated to approve it. Sellers should ensure that stranded inventory is set for removal rather than disposal as Amazon rarely overrides account settings. Disposed funds are not generally eligible for reimbursement.
Do I have to go to arbitration to recover withheld funds?
Sometimes. Internal escalations offer one path to disbursement. Written demands to Amazon’s legal team are another option.Arbitration is the final path to funds recovery in cases where Amazon’s internal teams and legal team deny a funds disbursement request.
Your Account and Your Balance Are Two Separate Claims
Sellers frequently abandon or write-off their funds when their appeals for reinstatement fail. Account reinstatement and funds recovery are two different paths. While sellers do not have a proverbial “right” to sell on Amazon, they still have a legal right to the funds – especially if Amazon has not identified a contractual basis for permanent withholding. Talk to our attorneys about your withheld funds before you abandon them or write them off entirely.
